In the event of any conflict between the English and other language versions, the English version shall prevail. VIVA shall have the right to modify, update or amend the terms of this Notice at any time by placing the updated Notice on the VIVA’S website (“Website”). By continuing to communicate with VIVA or by continuing to have dealings with VIVA following the modifications, updates or amendments to this Notice, this shall signify your acceptance of such modifications, updates or amendments.

In the course of your dealings with VIVA or communicating with VIVA or by using its website, products or services, you consent to the processing of your Personal Data by VIVA and all persons involved in the provision of services by VIVA.

Notis Data Peribadi ini ("Notis") menerangkan bagaimana VIVA PARADISE SDN BHD (Company Registration No: 201201020704 (1005196-W)) dan syarikat-syarikat induknya, anak syarikatnya, syarikat berkaitan, syarikat bersekutu dan syarikat usaha sama serta wakilnya (“VIVA”) menggunakan Data Peribadi anda yang mungkin dikutip dan diproses dalam operasi harian dan dalam urusan perniagaan biasa menurut Akta Perlindungan Data Peribadi 2010 (“PDPA”) di Malaysia.

Sekiranya berlaku sebarang percanggahan di antara versi Bahasa Inggeris dan versi bahasa lain, versi Bahasa Inggeris akan diguna pakai. Sebagai tambahan kepada Data Peribadi yang anda berikan kepada VIVA secara langsung, VIVA juga mungkin mengutip Data Peribadi anda daripada pelbagai sumber, termasuk tetapi tidak terhad kepada rakan perniagaannya, domain awam seperti laman web, kad nama, pesanan pembelian, atau individu tersebut berinteraksi dan berhubung dengan VIVA.

• Untuk memproses dan menilai permohonan pekerjaan di VIVA;

• tujuan lain yang berkaitan dengan perkara di atas,

  dan anda bersetuju dan mengizinkan VIVA untuk menggunakan dan memproses Data Peribadi anda menurut cara sebagaimana yang dikenalpastikan dalam Notis ini.

Tujuan pemasaran dan promosi

6. VIVA oleh juga menggunakan dan memproses data anda untuk tujuan pemasaran dan promosi seperti:-

• Untuk menghantar maklumat atau komunikasi pemasaran yang efektif dan bersasar kepada pelanggan;

• Untuk mengedar maklumat atau butir-butir acara, seminar, persidangan dan ceramah yang mungkin anda minati

• Memberi maklumat terkini berkenaan faedah oleh VIVA;

• Menghubungi pelanggan berkaitan perkhidmatan dan tawaran yang berkenaan;

  Melalui emel, pos atau panggilan telefon (“Tujuan Pemasaran dan Promosi”).
  Sekiranya anda tidak bersetuju dengan VIVA memproses Data Peribadi anda untuk Tujuan Pemasaran dan Promosi, sila hubungi VIVA dengan menggunakan butiran hubungan di bawah.

Pemindahan Data Peribadi

7. Data Peribadi anda mungkin dipindahkan, disimpan, digunakan dan diproses dalam bidang kuasa selain daripada Malaysia, seperti berikut:

• Di mana fungsi pentadbiran VIVA dijalankan di luar Malaysia;

• Di mana pelayan atau pelayan sandaran VIVA terletak di luar Malaysia;

• Di mana Data Peribadi perlu diberikan kepada pihak berkuasa di luar Malaysia;

• Di mana penyedia perkhidmatan, kontraktor, ejen atau rakan kongsi VIVA terletak di luar Malaysia.

Bagaimana VIVA Melindungi Data Peribadi Anda

8. VIVA akan menyimpan dan memproses Data Peribadi anda dengan cara yang selamat dan sebaiknya, di mana mungkin, untuk melaksanakan perlindungan dan prosedur pentadbiran dan keselamatan yang sesuai sesuai dengan undang-undang dan peraturan yang berlaku untuk mencegah pemprosesan dan pendedahan Data Peribadi yang tidak sah dan kehilangan atau pemusnahan, atau kerosakan Data Peribadi tersebut. VIVA menggunakan prosedur dan ciri keselamatan yang ketat untuk mengelakkan akses yang tidak dibenarkan sebaik mungkin. Pendedahan kepada Pihak Ketiga

9. Maklumat Peribadi mungkin dihantar, diakses atau didedahkan kepada pihak ketiga untuk Tujuan Pemasaran dan Promosi. Tambahan, VIVA boleh melantik syarikat-syarikat, penyedia- penyedia perkhidmatan atau individu-individu lain untuk melaksanakan fungsi bagi pihak VIVA seperti yang disenaraikan di bawah (tidak terhad):-

1. Penasihat professional VIVA termasuk penasihat undang-undang, juru audit, penyedia insurans, akauntan dan perunding;

2. Penyedia-penyedia perkhidmatan VIVA termasuk Penyedia-penyedia perkhidmatan teknologi maklumat (IT), perkhidmatan penghantaran, dan penyedia-penyedia perkhidmatan pembaikian peralatan dan syarikat-syarikat utiliti;

3. Syarikat-syarikat induk VIVA or anak syarikat VIVA, atau anak syarikat/subsidiary syarikat induk dan syarikat kumpulan VIVA; dan

4. Pihak berkuasa kawal selia dan kerajaan bagi mematuhi syarat-syarat di bawah undang- undang dan kerajaan.

   Data Peribadi anda mungkin juga didedahkan berkaitan dengan transaksi korporat melibatkan VIVA seperti jualan anak syarikat atau pembahagian, penggabungan, atau penjualan aset, atau sekiranya berlaku penggulungan.

Akses &Permohonan Pembetulan dan Pertanyaan

Tertakluk kepada sebarang pengecualian di bawah undang-undang yang diguna pakai, anda boleh pada bila-bila masa selepas ini memohon akses kepada, atau untuk pembaikan dan pembetulan Data Peribadi anda atau menghadkan pemprosesan Data Peribadi anda, atau memohon maklumat lanjut atau membuat aduan berkenaan pemprosesan Data Peribadi anda dengan menghubungi:-

Berkenaan dengan hak anda untuk mengakses dan/atau membetulkan Data Peribadi anda, VIVA berhak untuk menolak permohonan anda untuk mengakses dan/atau membuat sebarang pembetulan pada Data Peribadi anda atas alasan-alasan yang dibenarkan di bawah undang-undang. VIVA berhak mengenakan yuran pentadbiran untuk mendapatkan rekod Data Peribadi anda di bawah undang-undang. Jikalau dibenarkan, VIVA akan memaklumkan yuran sebelum memproses permohonan anda.

Maklumat Peribadi Individu Lain
